On April 16, Simon Cuevas was brutally beaten and shot shortly after leaving San Antonio Independent School District’s Brewer Academy. Authorities report that a group of five individuals followed him, and moments later, he was attacked at the intersection of Elmendorf Street and Merida Street. Surveillance footage shows the suspects fleeing the scene immediately after the violent incident.
Originally, all five suspects faced capital murder charges. However, as of now, their charges have been reduced to a third-degree felony for injury to a child with bodily injury. Among those affected are Fernando Flores and Andrew Cantu, both 18 years old, who are yet to be sentenced. Two younger brothers, aged 14 and 15, received sentences to the Texas Juvenile Justice Department on November 6 based on their behavior and progress. Tragically, Caesar Tijerina, 20, died from a self-inflicted gunshot wound in August.
Local defense attorney Karl Alexander commented on the situation, stating, “It seems very shocking that someone can be arrested for capital murder and then suddenly a charge that is significantly less serious than that actually gets filed.” He explained that charges can be downgraded for various reasons, including potential flaws in the evidence or premature police action.
“It’s a public safety concern,” Alexander emphasized. “You have to make an arrest and get someone off the street.
