UPDATE: A judge has just dismissed a lawsuit aimed at halting the construction of a new $189 million government center in James City County. On Thursday, Judge Jan Brodie ruled that the county’s bond agreement, approved in October 2024, was valid and could not be challenged because no appeal was filed within the initial 30 days.
The lawsuit, filed by seven residents in November, sought to require a public referendum on the project, arguing that incurring long-term debt should involve voter approval. The judge’s ruling means that the county can proceed with the planned construction at 5231 Longhill Road, which also includes a $25 million library annex.
The plaintiffs had requested an emergency injunction to stop the project, but their motion was denied. Christopher Woodfin, the attorney representing the plaintiffs, expressed disappointment but acknowledged the court’s decision. “We respect the ruling, but many in the community feel their voices are not being heard on such significant financial commitments,” said Woodfin.
Supporters of the new government center argue that the current facilities, located off Mounts Bay Road, are outdated and insufficient for the growing needs of the county’s population, which is projected to increase in the coming years. County officials have highlighted the necessity of the new center, citing that space needs studies dating back to 2020 have shown a critical demand for updated public facilities.
Charles Colgrove, one of the plaintiffs, emphasized the importance of community input on financial decisions that affect all residents. “Citizens deserve a say in how their tax dollars are spent, especially on projects of this scale,” Colgrove stated.
As of Thursday evening, it remains unclear whether the plaintiffs will pursue an appeal against the ruling. County officials are now gearing up to move forward with construction plans, which were approved back in December 2023, further highlighting the urgent need for modernized government facilities.
