In a conversation with The Conversation U.S. senior politics editor, Naomi Schalit, John E. Jones III, former federal judge and current president of Dickinson College, outlined the troubling implications of recent developments in America’s legal landscape.

The judiciary has experienced a significant increase in public discourse, with many judges expressing unease regarding the Trump administration’s approach to the rule of law. Jones, who was appointed by President George W. Bush and served on the federal bench for two decades, highlighted a disturbing trend of presidential overreach. He emphasized that the current administration has taken unprecedented steps, such as dismissing officials from independent agencies, undermining their autonomy.

Jones pointed to a potential shift in judicial precedent that could allow the president to reshape independent agencies fundamentally. He noted, “Having listened to oral arguments, there’s very little question that the Supreme Court is going to overturn the ‘Humphreys Executor’ precedent.” This change could enable Trump to appoint individuals aligned with his agenda, thereby eroding the independence that these agencies have historically maintained.

The implications of this shift extend to the Supreme Court’s handling of cases. Jones expressed concern about the court’s use of its emergency docket, which allows for expedited decision-making with minimal explanation. This procedure can lead to confusion within lower courts, particularly in high-stakes cases such as those related to birthright citizenship. Jones remarked, “You may or may not be subject to what has been the accepted interpretation of the 14th Amendment,” depending on regional rulings that have arisen in response to the administration’s policies.

Jones noted, “It really puts the federal court system into a state of uncertainty and chaos.”

The administration’s approach has also raised constitutional questions regarding the president’s ability to make interim appointments beyond the legally mandated limit of 120 days. “Every court has found that the president’s appointment or attempted appointment beyond the first 120 days is unlawful and unconstitutional,” Jones stated. This limitation is crucial in maintaining the Senate’s role in the appointment process.

Jones’s reflections reveal a deep concern for the current state of justice in the United States. He argued that Trump’s actions demonstrate a lack of respect for the judicial system, illustrated by the pardoning of individuals linked to the January 6 insurrection. “The president believes the law is whatever he says it is at any given moment,” he remarked.

Additionally, he highlighted a troubling relationship between the White House and the Department of Justice, suggesting that the administration’s influence compromises the department’s integrity. “There is a seamless interface between the White House and the Department of Justice that is problematic,” he added, warning of the dangers posed when the president can unilaterally direct prosecutions.

Jones called for the Supreme Court to adopt a firmer stance against what he described as gamesmanship in lower courts. He emphasized that the judiciary is meant to function cohesively, with judges from various backgrounds united in their commitment to upholding justice. “Those who serve in the third branch — the nation’s courts — are all in this together,” he stated.
